Welcome to ByZara. By accessing or using our website and services, you ("user," "client," or "customer") agree to be bound by these Terms and Conditions ("T&Cs"). Please read these terms and conditions carefully before using our website or booking any of our services.

Acknowledgement

These T&Cs govern the use of ByZara and the agreement that operates between you and ByZara Limited ("Company", "we", "us", or "our"). By accessing or using the service, you agree to be bound by these T&Cs. If you disagree with any part of these T&Cs, you may not access the service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the service.

Your access to and use of the service is also conditioned on your acceptance of and compliance with our Privacy Policy. Our Privacy Policy describes our policies and procedures on the collection, use, and disclosure of your personal information when you use the website and tells you about your privacy rights and how the law protects you. Service Description and Scope

ByZara offers the following services:

  • Cleaning: Residential and commercial cleaning, including standard cleaning, deep cleaning, and routine cleaning schedules.
  • Laundry: Pickup, cleaning, ironing, folding, and delivery of garments and fabrics.
  • Errands: Handling errands, such as parcel deliveries, package returns, and grocery shopping.
  • Food Services: Meal preparation and delivery, including chef-prepared meals according to subscription packages.

Our services are available within Nairobi. Availability of services may be affected by local conditions, weather, or other factors beyond our control.

User Obligations

To use our services, you agree to:

  • Provide accurate information when booking services, including addresses, access details, and special instructions.
  • Ensure access to the property for cleaning or delivery of laundry.
  • Secure all personal valuables, fragile items, and hazardous materials.
  • Abide by our cancellation and rescheduling policies.

Failure to meet these obligations may result in service delays, cancellation, or additional fees.

User Accounts

To access our services, you are required to create an account with accurate and complete information. You are responsible for safeguarding your account credentials. If you become aware of any unauthorized use of your account, please notify us immediately.

You may not use a username that is offensive, vulgar, or violates the rights of another person or entity.

Placing Orders for Services

Orders can be placed through our website or customer service channels. Order confirmations are sent via email and a phone call from the Account Manager. Requests for changes or cancellations must be made at least 24 hours before the scheduled service time.

Cancellations made after this period may be subject to a cancellation fee. All cancellations are to be made through the website.

Pricing, Payments, and Refunds

  • Pricing: Service prices are listed on our website and are subject to change. Changes do not affect confirmed bookings.
  • Payment Methods: We accept payments via mobile money (M-Pesa) and credit/debit cards.
  • Refunds: Refunds are only issued for service non-fulfillment or cancellations made in accordance with our cancellation policy.

Service Delivery

  • Access to Property: The client must provide access for service delivery. Failure to do so may result in rescheduling and fees.
  • Timeliness: We strive to deliver services on time but are not liable for delays caused by traffic, weather, or other unforeseen events.
  • Special Instructions: Clients must provide specific handling instructions for items. We are not responsible for damage due to undisclosed instructions.

Loss, Damage, and Liability

  • Laundry Damage: ByZara is not responsible for damage caused by normal wear and tear or undisclosed care instructions.
  • Damage to Property: ByZara’s cleaners will take reasonable care, but we are not liable for pre-existing damage.
  • Lost Items: Report lost items within 7 days. Compensation is limited to the value of the lost item or its replacement.

Prohibited Activities

Clients are prohibited from making unreasonable requests, as well as:

  • Submitting illegal or hazardous materials for laundry or cleaning.
  • Interfering with the work of service providers.
  • Engaging our service providers in unlawful activities.

Feedback

By submitting feedback, you grant ByZara a non-exclusive, perpetual, royalty-free, and worldwide right to use and modify the feedback without restriction.

Intellectual Property

All content on our website, including text, images, and software, is the property of ByZara. You may not copy, modify, or distribute any content without our consent.

Termination of Services

We may suspend or terminate your access to the service if you breach these T&Cs. Upon termination, your right to use the service ceases immediately.

Severability and Waiver

If any provision of these T&Cs is found to be invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right or provision of these T&Cs does not constitute a waiver of such right or provision.

Changes to the Terms and Conditions

We reserve the right to modify or update these T&Cs at our discretion. In the event of significant changes, we will provide at least 30 days' notice via email and through a notice on our website. Your continued use of the service after the effective date of the updated T&Cs constitutes acceptance of the new terms.

Governing Law and Dispute Resolution

These T&Cs are governed by the laws of Kenya. Disputes that cannot be resolved amicably will be subject to arbitration.
